Sen. John DeFrancisco, (R-NY), has introduced a bill that would increase the percentage of legal fees lawyers could receive in medical malpractice cases. The bill would repeal a current law that caps the percentage lawyers may receive. DeFrancisco’s bill would allow lawyers to collect up to 33% of malpractice payouts.  Read More…

I consult with attorneys and patients on a regular basis in malpractice suits, so I have seen a lot of things that are crazy, heartbreaking and egregious—or all three.  Hopefully, the Texas Supreme Court will bring some common sense into this case. Of note is the fact that even if the court rectifies this situation, the mother will never have the satisfaction of seeing this doctor and his malpractice carrier brought to justice.
