CMS Takes Stand on Rated Ages in Medicare Set Aside Allocations

Effective April 21, 2009, CMS has stated that if rated ages do not conform to their standards for “acceptable proof” the allocations will be priced using the actual age and CMS will not consider re-pricing the case even using new or corrected information.

Per CMS acceptable proof of a Rated Age must include the following:

  • be independent
  • on letterhead of insurance carrier or settlement broker

The submitter must then state clearly that “all rated ages obtained on the claimant have been included.”
