Accidents Involving Seniors Requires Special Consideration

An interesting post by Ottawa Law Firm, peaked my interest. The post suggests that when a senior is involved in a motor vehicle accident that there are additional issues that they might face. These include…
- You have some pre-existing aches and pains that the insurance company will try to suggest are the cause of your limitations post accident.
- Based on life expectancy charts, you will not live more than “x” years, so that’s all the insurance company will want to pay for, regardless of your health or the longevity of your family.
- You lived a “quiet life” before the accident so your activities have not changed much, even if you are in pain.
- You would have needed assistance of some sort shortly after the accident anyway.
While this was obviously targeted at new clients, I have to agree. As a legal nurse consultant and life care planner who has worked with both the plaintiff and defense in similar cases, these issues are often brought to a head in the course of the case. I like to get to know the clients to understand how they were personally affected by the accident. As a Life Care Planner I also address life activities so that regardless of their interests or activities before the accident, that they are able to continue these same interests following the accident.
